Terms of Service

These Terms of Service ("Terms") govern your access to and use of ChitsVyapar ("Service"), provided by ChitsVyapar ("we", "us"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally able to enter into a contract under Indian law to use the Service. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

2. The Service

ChitsVyapar is a software tool that helps registered foremen, organisers, and members manage chit fund records — group setup, member tracking, payment recording, due reminders, and basic reports. It is a record-keeping and communications tool only.

We are not a chit fund company, foreman, registrar, or financial institution. We do not hold subscriber funds, do not auction tickets, and do not act as a party to your chit agreement. Compliance with the Chit Funds Act, 1982, applicable state rules, and any registration requirements is solely your responsibility.

3. Your account

• You are responsible for keeping your login credentials confidential.
• You are responsible for all activity under your account.
• Notify us at ChitsVyapar@gmail.com if you suspect unauthorised access.

4. Your data and content

You retain ownership of all data you upload (member details, payments, transactions). By using the Service you grant us a limited licence to process that data solely to operate the Service for you. See our Privacy Policy.

You represent and warrant that you have the lawful basis to upload information about chit group members, including their consent under the DPDP Act where required, and that you will respond to their data subject requests as data fiduciary.

5. Acceptable use

You agree not to:

• Use the Service for unlawful purposes, including operating an unregistered chit fund where registration is required
• Send spam, harassing, or unsolicited messages via the Service's reminder features
• Attempt to access another user's account or data
• Reverse-engineer, scrape, or interfere with the Service's normal operation
• Upload malware or content that infringes third-party rights

6. Fees and payment

ChitsVyapar offers a free tier and optional paid plans. Paid plan pricing and billing cycles are shown on the Pricing page. We reserve the right to introduce or change paid plans on 15 days' notice.

Refunds are governed by our Refund Policy.

7. WhatsApp / SMS reminders

Reminder messages are sent on your behalf using your configured WhatsApp Business or SMS provider. You are responsible for: obtaining consent from recipients, complying with messaging-platform policies, and any costs charged by the messaging provider. We act as a passthrough only.

8. Service availability

We aim for high availability but do not guarantee uninterrupted Service. We may perform maintenance, change features, or temporarily suspend access. We will give reasonable notice of planned maintenance where practical.

9. Suspension and termination

We may suspend or terminate your account if you breach these Terms, if required by law, or if your use creates risk to the Service or other users. You may close your account at any time via the Account settings page or by emailing ChitsVyapar@gmail.com.

On termination, we will delete your data per the retention schedule in our Privacy Policy. You may export your data before deletion by contacting us.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We make no representations about the accuracy or completeness of computed balances, due dates, or other figures — you remain responsible for verifying records.

11. Limitation of liability

To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the fees you paid us in the 3 months preceding the claim or (b) ₹1,000. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profit, data, or goodwill.

12. Indemnity

You agree to indemnify and hold us harmless from claims, damages, and expenses arising out of (a) your breach of these Terms, (b) your unauthorised use of the Service, (c) your violation of any law or third-party right, including in your use of WhatsApp / SMS reminders, or (d) your operation of any chit fund.

13. Governing law and disputes

These Terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts at Hyderabad, Telangana.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email and/or in-app notice at least 15 days before they take effect. Continued use after the effective date constitutes acceptance.
