ChitsVyapar is a SaaS record-keeping and member-management tool. It is not a chit-fund operator, financial institution, NBFC, wallet, payment system, or investment platform. Use of the Service does not create any deposit, custody, or financial relationship between us and your members.

1. What this Service is

The Service is software that helps registered chit-fund operators, foremen, and organisers keep their books in order — configuring groups, recording memberships, logging collections and payouts, sending reminders, and reviewing operational metrics. We are a record-keeping and communications tool. Nothing more.

2. What this Service is not

  • We are not a chit fund company, foreman, or registrar.
  • We do not collect public deposits or accept money from chit subscribers.
  • We do not hold, store, or transfer customer funds. Money flows between operators and members happen outside this platform.
  • We do not act as a payment system, wallet, prepaid instrument, or NBFC.
  • We do not guarantee returns, profits, ranking in any auction, on-time payouts, or that any chit cycle will complete.
  • We do not verify the legality of any specific chit you operate. Registration under the Chit Funds Act, 1982 and applicable state rules is your responsibility.

3. No financial advice

Reports, dashboards, and operational metrics inside the Service are informational summaries computed from entries you record. They are not financial, investment, tax, or legal advice. You must independently verify all balances, due dates, and totals before acting on them.

4. Operator responsibilities

If you use the Service to run a chit fund, you remain solely responsible for:

  • Registering with the appropriate Registrar of Chits under the Chit Funds Act, 1982 and applicable state rules, where required.
  • Compliance with KYC, anti-money-laundering, taxation, GST, and consumer-protection obligations applicable to your operations.
  • The lawful collection of contributions, conduct of auctions, and disbursement of prize amounts to subscribers.
  • Maintaining your own bank or settlement accounts. We do not provide accounts of any kind.
  • Obtaining consent from members before recording their personal data, and responding to any data-subject requests under the DPDP Act, 2023.

5. Payments and money

The Service records payment events. It does not process them. When you log a collection — cash, UPI, bank transfer, or other — you are recording an event that already happened (or will happen) between you and your member, outside this platform. We do not initiate, authorise, route, settle, or refund any member payment.

Any SaaS subscription fees you pay us are processed by third-party payment gateways. Those gateways operate under their own terms, are responsible for securing your card data, and are the only parties that hold your subscription payment briefly during settlement. We never store your card or banking credentials.

6. Messaging

WhatsApp and SMS reminders are sent via third-party messaging providers on your behalf, using messaging credentials you configure. We do not operate the underlying messaging network. You are responsible for obtaining recipient consent and for complying with each messaging provider's policies.

7. Accuracy and availability

The Service is provided on an "as is" and "as available" basis. We do not warrant that computed balances or reminders are error-free, or that the Service will be uninterrupted. See the Terms of Service for full disclaimers and limitations of liability.

8. No solicitation

Nothing on this Service, the marketing site, or in any associated material constitutes an offer, solicitation, or invitation to invest, deposit funds, or participate in any chit scheme operated by ChitsVyapar. Any chit you join is a contract between you and the operator running it.

9. Local law

Users are solely responsible for ensuring their use of the Service complies with the laws and regulations of their jurisdiction, including but not limited to the Chit Funds Act, 1982, applicable state chit-fund rules, the Reserve Bank of India Act, 1934, the Prize Chits and Money Circulation Schemes (Banning) Act, 1978, the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023.
